We respect your privacy and are committed to protecting it through our compliance with this privacy policy ("Policy"). This Policy describes the types of information we collect from you or that you may provide ("Personal Information") on the revitalizingnurses.com website ("Website" or "Service") and any of its related products and services (collectively, "Services"), and our practices for collecting, using, maintaining, protecting, and disclosing that Personal Information. It also describes the choices available to you regarding our use of your Personal Information and how you can access and update it.

This Policy is a legally binding agreement between you ("User", "you" or "your") and JL Nurse Consulting (doing business as "Revitalizing Nurses", "we", "us" or "our"). By accessing and using the Website and Services, you acknowledge that you have read, understood, and agree to be bound by the terms of this Policy. If you do not agree with the terms of this Policy, you must not access or use the Website and Services. This Policy does not apply to the practices of companies we do not own or control, or to individuals we do not employ or manage.

Important notice for healthcare professionals

Revitalizing Nurses is an educational business. It is not a healthcare provider, a HIPAA covered entity, or a business associate of any covered entity. The information we collect from you is ordinary business and marketing information about you as a customer. It is not protected health information, and it is not governed by HIPAA.

Do not submit any patient information to us through any channel, including forms, email, community spaces, live sessions, direct messages, or comments. This includes patient names, dates of service, facility or unit names, medical record numbers, and any combination of details from which an individual patient could be identified. You are solely responsible for de-identifying any clinical scenario you describe to us or to other users. We may delete any submission containing patient information and may terminate your access.

1. Information we collect

You can browse most of the Website without telling us who you are. If you wish to use certain features, you may be asked to provide Personal Information.

Information you give us directly. When you subscribe to our email list, create an account, make a purchase, complete a form or survey, participate in a community space or live session, or contact us, we collect:

  • Contact information, such as your name and email address
  • Account details, such as your username and unique user ID
  • Professional information you choose to share, such as your years of experience, unit or specialty, or role
  • Order and transaction records, such as what you purchased and when
  • Any content you choose to submit, such as questions, feedback, survey responses, testimonials, or community posts

Information collected automatically. When you visit the Website, we and our service providers may automatically collect standard internet and device information, including your IP address, approximate location derived from your IP address (such as city, region, and country), browser and device type, referring page, pages viewed, and time spent on the Website.

Information from other sources. If you interact with us through a social media platform, we may receive limited information from that platform, such as your username and the content of your interaction, in accordance with that platform's settings and policies.

We do not collect precise device geolocation. We do not collect or store your full payment card number or bank account details. See section 3.

2. How we use your information

We use the information we collect to:

  • Create and manage your account
  • Fulfill orders and deliver the products and services you purchase
  • Provide access to courses, downloads, community spaces, and live sessions
  • Send transactional and administrative messages relating to your purchase or account
  • Send marketing and promotional emails, where you have subscribed
  • Respond to your questions and provide support
  • Request and, with your permission, publish testimonials and feedback
  • Improve our products, services, and website
  • Measure and improve the performance of our advertising
  • Enforce our terms and policies, prevent fraud and abuse, and protect the rights and safety of our users and of ourselves
  • Comply with legal obligations and respond to lawful requests

We act as a data controller with respect to the Personal Information described in this Policy. We determine the purposes and means of processing it.

Where required by law, we rely on the following legal bases for processing: your consent; the performance of a contract with you; compliance with a legal obligation; and our legitimate interests in operating, securing, and improving our business, where those interests are not overridden by your rights.

3. Payment processing

When you make a purchase, payment is processed by third-party payment processors. We do not collect, process, or store your full payment card number, card security code, or bank account details. Our payment processors collect that information directly and process it under their own privacy policies and under the security standards maintained by the PCI Security Standards Council.

We receive from our payment processors only the information necessary to fulfill and support your order, such as your name, email address, billing country and postal code, the last four digits of your card, and the amount and status of your transaction. We use that information to deliver your purchase, issue refunds, respond to billing questions, and maintain our financial records.

4. Advertising, analytics, and cookies

Cookies. The Website uses cookies and similar technologies. A cookie is a small text file placed on your device by a website. We use cookies for essential site functionality, to keep you logged in, to remember your preferences, to measure how the Website is used, and to measure and target advertising. Most browsers accept cookies by default, and you can change your browser settings to refuse cookies or to alert you when a cookie is being sent. Some features of the Website may not function properly if you refuse cookies.

Analytics. We use Kajabi's built-in analytics and Google Analytics to understand how visitors find and use the Website, such as which pages are visited, for how long, and from what source. This information is used in aggregate to improve the Website.

Advertising. We advertise our products on third-party platforms, including social media platforms. We use advertising and measurement technologies provided by those platforms, such as tracking pixels, which may collect information about your visit to our Website and connect it to your account on that platform. This allows us to measure whether our advertising works, to show our ads to people who have visited our Website, and to reach people with similar interests.

Under some state privacy laws, this use of advertising technology may be considered a "sale" or a "sharing" of personal information, even though we receive no money for it. You have the right to opt out. See section 8.

To learn more about interest-based advertising and your choices, you can visit the Digital Advertising Alliance and the Network Advertising Initiative websites, or adjust the ad settings in your account on the relevant social media platform.

Global Privacy Control. Where required by applicable law, we honor opt-out preference signals such as Global Privacy Control that are sent by your browser or device.

5. Who we share information with

We do not sell your Personal Information for money.

We share your information with service providers who perform functions on our behalf and who are permitted to use it only for those functions. These include:

  • Our website, course, and community platform provider
  • Payment processors
  • Email delivery and marketing platforms
  • Analytics providers
  • Advertising and social media platforms, as described in section 4
  • Scheduling, video conferencing, and customer support tools
  • Professional advisors, such as our accountant and attorneys

We may also disclose Personal Information if required or permitted by law, such as to comply with a subpoena or similar legal process, or when we believe in good faith that disclosure is necessary to protect our rights, protect the safety of any person, investigate fraud, or respond to a lawful government request.

If our business is involved in a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction. We will notify you before your information becomes subject to a materially different privacy policy.

6. Where your information is stored

We are based in the United States, and our service providers store and process information primarily in the United States. If you access the Website or Services from outside the United States, you understand that your Personal Information will be transferred to, stored in, and processed in the United States, where data protection laws may differ from those in your country. By using the Website and Services and providing your Personal Information, you consent to that transfer and processing.

Where we transfer Personal Information from the European Economic Area, the United Kingdom, or Switzerland, we rely on appropriate safeguards permitted by applicable law.

7. How long we keep information

We keep your Personal Information for as long as your account is active, as long as needed to provide the Services you have purchased, and thereafter for as long as necessary to comply with our legal, tax, and accounting obligations, to resolve disputes, and to enforce our agreements.

If you unsubscribe from marketing emails, we retain a minimal record of your email address so that we can honor your unsubscribe request.

We may retain and use aggregated or de-identified information that can no longer reasonably be used to identify you.

8. Your privacy rights

Depending on where you live, you may have some or all of the following rights regarding your Personal Information:

  • The right to know and access. Request confirmation of whether we process your Personal Information, and a copy of the Personal Information we hold about you, the categories of sources it came from, and the purposes for which we use it.
  • The right to correct. Request that we correct inaccurate Personal Information.
  • The right to delete. Request that we delete your Personal Information.
  • The right to data portability. Request your Personal Information in a portable and readily usable format, where technically feasible.
  • The right to opt out of targeted advertising and of the sale or sharing of Personal Information. See section 4.
  • The right to withdraw consent. Withdraw consent at any time where we rely on consent to process your information.
  • The right to limit the use of sensitive personal information. We do not use sensitive personal information for any purpose beyond what is necessary to provide the Services.
  • The right to non-discrimination. We will not deny you services, charge you a different price, or provide a different quality of service because you exercised any of these rights.
  • The right to appeal. If we decline your request, you may appeal by replying to our response. Where required by law, we will explain the outcome of your appeal and how to contact your state attorney general.
  • The right to complain. You may lodge a complaint with your state attorney general or your applicable data protection authority.

California "Shine the Light." California residents with an established business relationship with us may request information about disclosures of personal information to third parties for those third parties' direct marketing purposes, or opt out of such disclosures. We do not currently make such disclosures.

Some of these rights are provided by specific state or national laws and may not apply to every user or in every circumstance. We aim to honor requests from all users regardless of where they live, subject to our legal obligations and our ability to verify the request.

9. How to exercise your rights

We may ask you to verify your identity before responding, and your request must include enough detail for us to understand and respond to it. If a request is submitted on your behalf by an authorized agent, we may require proof of that authority.

We will respond within the timeframe required by applicable law. You may also manage some of your information directly, by updating your account settings or by using the unsubscribe link in any marketing email.

10. Children's privacy

The Website and Services are intended for adults. We do not knowingly collect Personal Information from anyone under the age of 18. If you are under 18, please do not submit any Personal Information through the Website and Services. If you believe someone under 18 has provided us with Personal Information, contact us and we will delete it.

11. Email marketing

We send email newsletters and marketing emails to people who have voluntarily subscribed. We do not sell or rent your email address.

In compliance with the CAN-SPAM Act, every marketing email identifies who it is from, includes our physical mailing address, and includes a working unsubscribe link. You may unsubscribe at any time by using that link or by contacting us. If you unsubscribe from marketing emails, you will still receive transactional emails relating to purchases you have made and to your account.

12. Affiliate links

The Website and Services may contain affiliate links. If you click an affiliate link and make a purchase, we may receive a commission at no additional cost to you, and a cookie may be placed on your browser to attribute that sale. Where content is sponsored or an affiliate relationship exists, we disclose it.

13. Links to other resources

The Website and Services contain links to resources we do not own or control. We are not responsible for the privacy practices of those resources. We encourage you to read the privacy policy of every resource that may collect Personal Information from you.

14. Information security

We maintain reasonable administrative, technical, and physical safeguards designed to protect Personal Information in our control against unauthorized access, use, modification, and disclosure. However, no method of transmission over the internet and no method of electronic storage is completely secure. You acknowledge that we cannot guarantee the security, integrity, or privacy of information transmitted to or from the Website and Services.

Because the security of your information also depends on the security of your own devices and credentials, please take appropriate steps to protect them, including using a strong and unique password.

15. Data breach

If we become aware that the security of the Website and Services has been compromised or that Personal Information has been disclosed to unrelated third parties as a result of external activity, we will take reasonably appropriate measures, including investigation and, where appropriate, reporting to and cooperating with law enforcement.

Where there is a reasonable risk of harm to you, or where notice is otherwise required by law, we will notify affected individuals by email and by posting a notice on the Website, and will notify the relevant authorities where required.

We may modify this Policy at any time at our discretion. When we do, we will revise the updated date at the bottom of this page and may notify you in other ways, such as by email. An updated version is effective immediately upon posting unless otherwise specified. Your continued use of the Website and Services after the effective date constitutes your acceptance of the changes. We will not use your Personal Information in a manner materially different from what was stated at the time it was collected without your consent.

You acknowledge that you have read this Policy and agree to all of its terms and conditions. By accessing and using the Website and Services and submitting your information, you agree to be bound by this Policy. If you do not agree, you are not authorized to access or use the Website and Services.
